Governor Wolf Signs Turfgrass Fertilizer Bill in Law - Following 12 years of debate and failed attempts to pass state-wide legislation, Pennsylvania now has a law governing turfgrass fertilizer application dates, practices, rates, and type of fertilizer used. On July 11, Governor Wolf signed SB 251, a bipartisan bill sponsored by Senator Gene Yaw (R) and Senator Carolyn Comitta (D), into law. Currently known as “Act 83 of 2022”, the new law omits a controversial applicator licensing and certification program included in previous versions of the bill, but retains the following provisions for turfgrass fertilizer applicators:
- Applications near water:The law states that no person may apply nonaquatic fertilizer within 15 feet of the top of a bank of a lake, pond, wetland, or flowing body of water (stream, river, or creek). However, fertilizer may be applied to the top of a waterway bank if using a drop spreader, rotary spreader with deflector, targeted spray liquid or other targeted application technology when establishing and maintaining a stream buffer zone. The setbacks for fertilizer applications near waterways do not preclude environmental standards established under other federal or state laws.
- Nitrogen: Nitrogen application rates shall not exceed 0.7 pounds of readily available nitrogen per 1,000 sq ft per application, and shall not exceed 0.9 pounds of total nitrogen per 1,000 sq ft per application, except when labeled as an enhanced-efficiency nitrogen fertilizer, where the amount of nitrogen released at any given time shall not exceed 0.7 pounds of nitrogen per 1,000 sq ft.
- Phosphorus: Turfgrass fertilizer shall contain no phosphorus except when specifically labeled for establishing vegetation (turfgrass) for the first time; reestablishing or repairing a turf area; or as an enhanced-efficiency phosphorus fertilizer, natural organic fertilizer, or organic-based fertilizer, if the application rate does not exceed 0.25 pounds of phosphorus per 1,000 sq ft per application, with a maximum total annual application of 0.5 pounds of phosphorus per 1,000 sq ft.
- Exceptions to nitrogen and phosphorus rate restrictions:Turfgrass fertilizer applicators are not required to follow the above nitrogen and phosphorus application rate restrictions if a site-specific plan is used and is based on all the following criteria:
- A soil test is conducted within the previous three years according to procedures recommended by Penn State.
- Soil, plant species, climate, turf use, topography, or other appropriate management factors are accounted for in the plan.
- Rates recommended by Penn State or another institution of higher education in the Commonwealth are approved by the PA Dept. of Agriculture.
- Impervious surfaces:The law states that no person may apply turf fertilizer to an impervious surface (sidewalk, driveway, street, etc.). Turf fertilizer that is inadvertently applied to an impervious surface must be removed from the impervious surface immediately following the application.
- Conditions and date restrictions:No person may apply fertilizer containing nitrogen or phosphorus to turf at any time when the ground is frozen to a depth of at least two inches or snow covered. No person may apply fertilizer containing nitrogen or phosphorus to turf after December 15 and before March 1.
- Equipment:Another provision of the law is that no person may apply fertilizer with a device that is not intended for the application of fertilizer or that has not been properly calibrated; operate fertilizer application equipment or devices in a faulty, careless or negligent manner; dispose of, discard or store a fertilizer product in a manner that is inconsistent with its label, would cause over-application of fertilizer, or would result in direct discharge to a storm drain or waters of the Commonwealth.

Gov. Wolf: Effective April 4, More Options for Restaurants and Other Businesses, Mass Gathering Maximums Increase
Harrisburg, PA – As COVID-19 cases have declined and vaccination rates are climbing, Governor Tom Wolf today announced the lifting of some targeted restrictions on restaurants and other businesses, as well as increased gathering limits.
Effective April 4, restaurants may resume bar service; alcohol service will be allowed without the purchase of food; the curfew for removing alcoholic drinks from tables will be lifted; and indoor dining capacity will be raised to 75 percent for those restaurants that are currently self-certified and those that undergo the self-certification process, which involves agreeing to strictly comply to all public health safety guidelines and orders, including the cleaning and mitigation protocols and other operational requirements contained in the Governor and Secretary of Health’s mitigation and enforcement orders issued on November 23, 2020, as amended. Those restaurants that do not self-certify may raise capacity to 50 percent. Outdoor dining, curbside pick-up and takeout are still encouraged.
Requirements such as mask-wearing, and social distancing, including 6 feet between diners, also still apply.
Capacity for other businesses also will be increased effective April 4, including moving personal services facilities, gyms and entertainment facilities (casinos, theatres, malls) to 75 percent occupancy.
The governor also announced revised maximum occupancy limits for indoor events to allow for 25% of maximum occupancy, regardless of venue size, and maximum occupancy limits for outdoor events to allow for 50% of maximum occupancy, regardless of venue size. Maximum occupancy is permitted only if attendees and workers are able to comply with the 6-foot physical distancing requirement.
“Pennsylvanians have stepped up and done their part of help curb the spread of COVID-19,” Gov. Wolf said. “Our case counts continue to go down, hospitalizations are declining, and the percent positivity rate gets lower every week – all very positive signs. The number of people getting vaccinated increases daily and we are seeing light at the end of the tunnel. It’s time to allow our restaurants, bars and other service businesses to get back to more normal operations.”
While the lifting of these restrictions is good news, Gov. Wolf cautioned that mask-wearing, social distancing and business adherence to all safety orders are still imperative.
“We’ve come so far and now is not the time to stop the safety measures we have in place to protect ourselves, our families and our communities,” Gov. Wolf said. “Keep wearing a mask, social distancing, and, please, get vaccinated when it’s your turn.”

- The limit for indoor events is now 15% of maximum occupancy regardless of venue size and 6-foot physical distancing is still required.
- The limit for outdoor events is now 20% of maximum occupancy regardless of venue size and 6-foot physical distancing is still required.
- Out-of-state travel restrictions were lifted. It is no longer necessary for travelers to Pennsylvania to have a negative COVID test or 14-day self-quarantine.

Governor Wolf Announces Restaurants May Increase Indoor Occupancy to 50 Percent Starting September 21
Governor Wolf announced that restaurants may return to 50% capacity on September 21, but the restaurant must self-certify by Oct. 5 to do so. Today's order also imposed a 10 p.m. curfew for alcohol sales and kept the ban on bar service, meal requirement for alcohol purchases, and 25-person cap on private events intact.

Gov. Wolf announced new, targeted mitigation efforts on restaurants, bars, and nightclubs. These new efforts take effect at 12:01 a.m., July 16 and include the following guidelines:
- Prohibition from conducting operations unless the facility offers sit-down, dine-in meals or is serving take-out sales of alcoholic beverages. All service must be at a table or booth; bar service is prohibited.
- Occupancy is limited to 25 percent of stated fire-code maximum occupancy for indoor dining, and indoor events/gatherings may not exceed 25 persons. The maximum occupancy limit includes staff.
- Alcohol only can be served for on-premises consumption when in the same transaction as a meal.
- Take-out sales of alcohol for the purposes of off-site consumption are permitted subject to any limitations or restrictions imposed by Pennsylvania law.
- Non-bar seating in outdoor areas (i.e. tables or counter seats that do not line up to a bar or food service area) may be used for customer seating.
- Social distancing, masking, and other mitigation measures must be employed to protect workers and patrons.
- The Pa. Department of Health issued updated FAQs on the expanded mask order.
- The Paycheck Protection Program resumed accepting applications at 9 a.m. on July 6, 2020, in response to the Paycheck Protection Program Extension Act. The new deadline to apply for a Paycheck Protection Program loan is August 8, 2020.
- The Small Business Administration today released PPP loan data.
- Data released for loans above $150,000:
- Borrowing entity name, address
- Number of jobs covered under the loan application
- Voluntary demographic info (race, gender, veteran’s status)
- Loan amount will be disclosed with a range (not specific dollar amount)

Secretary of Health Signs Extended Mask-Wearing Order
- Gov. Wolf announced 12 more counties will go green on June 26. These counties include Berks, Bucks, Chester, Delaware, Erie, Lackawanna, Lancaster, Lehigh, Montgomery, Northampton, Philadelphia and Susquehanna.
- Philadelphia County met the criteria and will move to the state’s green phase on June 26; however, local officials will maintain some additional restrictions until July 3.
- The only county that remains in yellow after June 26 is Lebanon County.
- The SBA and Treasury announced a revised, borrower-friendly PPP loan forgiveness application based on updates included through the PPP Flexibility Act (PPPFA). A new EZ version of the application is also available for borrowers that are self-employed or did not reduce salaries of employees by more than 25 percent.

PGA professional died last week following an on-course accident.
Justin Riegel, 38, was killed on last Wednesday when a tree crashed into Philmont Country Club’s pro shop and cart barn following a thunderstorm. Riegel was helping bring in carts from the rain at the Philadelphia course when the accident happened."The storm blew in and everyone was rushing in, and before we knew it a tree fell," Philmont employee Kelli Patrick told 6ABC.com. Riegel joined Philmont in 2019 as head pro, and was recently promoted to director of golf. According to the PGA Philadelphia website, Riegel previously worked at Aronimink G.C., Wilmington C.C. and Gulph Mills G.C as an assistant pro before earning his first PGA head professional position at French Creek G.C. In 2015, he was selected as the Section PGA Assistant Golf Professional of the Year.Riegel’s girlfriend, Kate Hannon, is due to have the couple’s first child in two weeks. A GoFundMe site has been set up to assist Riegel’s family.“Justin was one the most caring individuals you could ever come across. He was that guy who would call just to see how you’re doing and make sure everything was great in your life,” reads the site. “We’re raising funds to help Kate and the kids get through these awful times and to start a college fund for the kids. This afternoon, the PLCB made available on PLCB+ the application for licensees to temporarily extend their premise to permit additional space for outdoor dining.
There is no cost to apply and your application will be automatically approved. A summary of the temporary procedures are outlined below:
- Emergency temporary authority for outside areas may be requested by clubs, catering clubs, restaurants, retail dispensers, hotels, distilleries, limited distilleries, wineries, limited wineries, and breweries.
- Licensees that wish to apply for a temporary extension of the licensed premises to include outside serving areas, with this extension expiring at the end of the current public health emergency, may do so without paying the $220 filing fee.
- The application for temporary extension of premises to include an outdoor seating area will require the submission of a plan, and if the area to be licensed is an area not under the applicant’s control – such as a municipal sidewalk – then proof that the applicant has the right to occupy the location must be provided.
- A licensee may only submit an application for an outdoor area immediately adjacent to, abutting and contiguous to the existing licensed premises. Applications for locations not meeting these criteria will be rejected, and no temporary extensions are allowed for any locations separated from a licensed premises by a public thoroughfare.
- Upon submission of the application, the licensee will see a confirmation screen that the application was successfully submitted for processing. The licensee must print this confirmation page and display it as evidence the application was received, and at that point, the licensee will automatically have temporary authority to operate on the proposed outdoor area.

The Pennsylvania Alliance for Golf has received updated guidance from the Pennsylvania Governor's Office for golf facilities located in counties designated as yellow or green phases of reopening.
The Governor's Office has informed us that in the yellow phase, facilities may open, conduct in-person operations, and offer caddies and shared golf cars. These facilities must follow all the guidance to keep employees and customers safe. All employees should wear masks, clean / disinfect golf carts, etc., and social distancing remains in place. Beginning on June 5, those facilities that have a restaurant on site may offer outdoor dining at 50 percent capacity. Gatherings in the yellow phase are restricted to no more than 25 people.
In the green phase, facilities that have a restaurant on site may offer indoor dining at 50 percent capacity, in addition to in-person operations, caddies, shared golf cars, etc., all while maintaining social distancing. Gatherings of more than 250 people are prohibited. The following counties will move to green on June 5: Allegheny, Armstrong, Bedford, Blair, Butler, Cambria, Clinton, Fayette, Fulton, Greene, Indiana, Lycoming, Mercer, Somerset, Washington, and Westmoreland.
Golf facilities that are located in red counties may only offer golf cars as single occupant only, unless the occupants share a residence, and may not offer caddies. All remaining red counties are expected to move to yellow by June 5; these counties include: Berks, Bucks, Chester, Delaware, Lackawanna, Lancaster, Lehigh, Northampton, Montgomery, and Philadelphia.

As golfers emerge from their homes and head back to the course, it is important to recognize some of the new safety measures that are being implemented to keep the game safe for all. There has been plenty of innovation over the past two months such as inverted cups, pool noodles in the holes and even a nifty invention for snagging your ball from the hole, but even with these measures in place, there are still other things we can all do to keep everyone safe.
That’s where the Back2Golf initiative comes in. Back2Golf is a collaborative effort between the game’s allied organizations which outlines a plan of operational guidelines for golf facilities around the country which adhere to health safety guidelines and best practices.
Back2Golf has a three-phase approach for safely getting back to normal on the golf course, which you can see here, but for the first phase, social distancing is key. Here are the nine things every golfer should keep in mind as they get back to playing golf.
Follow these steps to be safe on the course.
- Always stay six feet apart from others -- This shouldn’t be a problem while on the course but be sure to be conscientious of your spacing in common areas such as the clubhouse, range and putting green.
- Stay home if you have a fever or feel sick -- We all love golf, but if you feel ill please stay home. The course will still be there when you get back on your feet.
- Avoid large gatherings -- Like rule No. 1, this one should be easy on the course but be careful before and after the round.
- If in doubt, don’t touch it -- Did the group ahead of you take out the flagstick and pass it around before replacing it? Maybe putt with the pin in today. Lucky for you, it’s totally legal.
- Always mark your ball clearly -- Make sure you can clearly identify your ball so you don’t accidentally grab the wrong ball while searching in the woods,
- Wear a facial covering when taking a lesson -- If you are going to be in close proximity to someone for an extended period, it’s probably safer to wear a mask.
- Avoid handshakes and high fives -- A nice fist bump will do for the time being.
- Respect the game and all involved -- Pandemic or not, this is something you should be doing at all times.
- Remember to wash your hands after playing -- Soap and water for at least 20 seconds!

NCA Advocacy Breakthrough Clubs Included in the Paycheck Protection Program Bill
The fifth relief package has been released by Democratic Leadership in the House of Representatives. In the package is a section on expanding eligibility for the Paycheck Protection Program. At first glance, it appears to open up the PPP to all 501(c) entities. While this is just the first step in what is sure to be a long process, NCA will continue to work toward a successful conclusion. The legislation is H.R. 6800, the HEROES Act and the language can be found on page 821 and 822.
I would like to thank all of you who weighed in with your members of Congress to make this happen. By speaking with one voice, we got our message through. While we have a long way to go, please be sure to reach out to your Representatives and thank them for including all 501(c) organizations in the Paycheck Protection Program.
The Pennsylvania Governor's Office today updated its guidance for golf course operations. The updated guidance affects golf car usage procedures, and now stipulates that "golf cars may be utilized, but must be single occupant only, unless the occupants share a residence."
In counties designated as being in the Red Phase of Reopening, golf course operators may permit individuals access to the property so long as there are no gatherings of any kind and appropriate social distancing of six feet between individuals is strictly abided.
In counties that have been designated as being in the Yellow Phase of Reopening, golf courses may conduct in-person operations as long as they strictly adhere to the requirements of the Guidance for Businesses Permitted to Operate During the COVID-19 Disaster Emergency to Ensure the Safety and Health of Employees and the Public (including the requirement to telework where possible), available here.

Governor Announces May 1 Statewide Reopening of Limited Outdoor Recreational Activities to Help Pennsylvanians Maintain Positive Physical, Mental Health
Harrisburg, PA – To ensure that Pennsylvanians have opportunities to safely enjoy outdoor recreation as a way to maintain positive physical and mental health, and in keeping with the commonwealth’s stay-at-home orders to mitigate the spread of COVID-19, Governor Tom Wolf today announced that the Wolf Administration is lifting some restrictions on businesses related to certain outdoor activities.
Starting Friday, May 1, golf courses, marinas, guided fishing trips and privately owned campgrounds may reopen statewide and are required to follow updated life-sustaining business guidance and FAQ issued by the Wolf Administration to include specifics for how these outdoor recreational industries can resume activities while prioritizing public health and safety. Campgrounds in state parks will remain closed through Thursday, May 14.
“Pennsylvanians have remained resilient throughout this COVID-19 crisis, and as we successfully continue to flatten the curve to protect our physical health, it is critical that we also focus on our physical and mental health during these extraordinary times. As the weather warms and daylight lengthens, enjoying time outdoors is an important way to manage stress,” Wolf said. “As we start to take measured, limited steps to reopen our commonwealth, reopening these industries will help to rebuild our economy and strengthen our mental health.”
According to a recent study by the Kaiser Family Foundation, nearly half (45 percent) of adults in the United States reported that their mental health has been negatively impacted due to worry and stress over COVID-19 with the burden likely to continue even as the pandemic’s threat diminishes.
The Centers for Disease Control and Prevention (CDC) issued guidance on visiting parks and recreational facilities. These guidelines must be followed statewide by businesses and when engaging in outdoor activity while the state disaster declaration remains in effect. The guidelines will ensure the safety of individuals and families engaging in outdoor activities and adherence will help slow the spread of COVID-19.
- Stay close to home: Pennsylvanians are encouraged to enjoy permitted outdoor recreational activities within their community and avoid crowding popular destinations.
- Practice social distancing: Maintain the recommended minimum 6 feet apart from fellow recreationists. Pennsylvanians are also encouraged to wear a mask or protective garment that covers the nose and mouth any time they go outside. If a parking lot at a park is full or there are too many people on the same trail, find an alternate place to recreate. Cross the street to avoid running directly past another runner or wait longer at a golf hole for a fellow golfer to move forward.
- Minimize risk to others: Individuals should only go out if they feel healthy and have not been exposed to someone who has tested positive for COVID-19.
- Practice good hygiene: Wash hands often with soap and warm water for 20 seconds. If soap and water are not available, use a hand sanitizer containing at least 60 percent alcohol. Avoid surfaces that are touched often, such as doorknobs and handrails.
- Have a plan: Create a safety plan before heading outdoors. Explain to children the need to keep their distance from others, even if they happen to see a friend while outside. Discuss with partners, social distancing while on the golf course. Think through how to avoid other runners when waiting to safely cross a street at the same time.
“Practicing social distancing takes a little planning and patience but it is necessary if we want to continue to flatten the curve while ensuring that Pennsylvanians have opportunities to de-stress and get exercise,” Wolf said. “Finding the balance between enjoying the outdoors and staying safe is only possible when all Pennsylvanians are abiding by the same precautions. It’s critical that all Pennsylvanians adhere to the safety guidelines to allow for these outdoor activities to remain available to the public.”

Governor Tom Wolf and Secretary of Health Dr. Rachel Levine today issued “Stay at Home” orders to Allegheny, Bucks, Chester, Delaware, Monroe, Montgomery, and Philadelphia counties, as the state seeks relief to save lives and stop the spread of COVID-19.
This order takes effect at 8:00 PM on Monday, March 23, 2020, and will continue until April 6, 2020.
The statement, “the more things change, the more they stay the same” DOES NOT apply to our current situation. As you are aware, updates and changes are being made by the hour. The latest information that we have received is as follows:
- Golf Association of Philadelphia - Joshua Arsenault, District Director for Pennsylvania Senator Maria Collett, has issued a statement indicating the Pennsylvania Department of Community and Economic Development (DCED) has now confirmed that landscaping is included under “Essential Services” as referenced in Governor Wolf’s Closure Order, and, therefore golf course superintendents in Pennsylvania may continue to maintain the grounds at this time. Arsenault also noted in a subsequent statement that this situation is evolving rapidly and this confirmation from DCED may be subject to change in the future.
We emphasize that the confirmation from DCED applies to Pennsylvania golf courses only. GAP will continue to monitor developments in New Jersey and Delaware.
- The Philadelphia PGA Section has received updates from Pennsylvania and New Jersey state legislators and officials in regard to how golf facilities are affected by executive action from both states' governors in efforts to slow the spread of COVID-19.
Pennsylvania: Courses should remain closed for all play until further notice; enforcement begins on Monday, March 23 at 8:00 a.m. Golf facilities may still continue to seek waivers from the state by emailing This email address is being protected from spambots. The Department of Community and Economic Development (DCED) has confirmed that landscaping (e.g. facility / course maintenance) has been included under "essential services," meaning superintendents may continue maintaining the grounds at this time.

As a reminder, Governor Tom Wolf's prohibition does not apply to virtual or telework operations. Full-service restaurants and limited-service eating places may continue to operate for takeout only.

The Golf Associations of Pennsylvania have been working together throughout the weekend to finalize the attached letter to Governor Wolf. We encourage you to forward this letter to your State Senator, House Representative, patrons, members, and everyone with an interest in golf. As you are aware, information and regulations are changing daily so you are still encourage to file a waiver with the governor’s office.
Upon completion of your waiver, forward copies of those to your Senator and Representative as well!
